Terms of Service

Please read these Terms of Service carefully before using Winnelo. By creating an account or accessing the platform, you agree to be bound by these terms. If you do not agree, you may not use Winnelo.
1. About Winnelo
Winnelo is a microlearning platform. The platform enables organisations to deliver competitive, quiz-based training to their teams. Administrators create and publish challenge content; learners complete challenges, earn XP, and compete on leaderboards.
2. Acceptance of Terms
By registering for an account, accepting an invitation, or otherwise using Winnelo, you confirm that you are at least 16 years old, have the authority to enter into these Terms (whether on your own behalf or on behalf of an organisation), and agree to comply with all applicable laws.
If you are accessing Winnelo on behalf of an organisation, "you" refers to that organisation, and you represent that you have authority to bind it to these Terms.
3. Accounts
Registration
To use Winnelo, you must register with a valid email address and create a password. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.
Account Types
Winnelo has two account roles: Administrators, who manage the organisation, create challenge content, and invite team members; and Learners, who participate in challenges and appear on leaderboards. Your role is set at account creation or by your organisation's administrator.
Account Security
You must notify us immediately at hello@winnelo.com if you suspect unauthorised access to your account. We are not liable for any loss resulting from unauthorised use of your credentials.
4. Use of the Platform
Permitted Use
You may use Winnelo solely for legitimate internal training and learning purposes within your organisation, in accordance with these Terms and all applicable laws.
Prohibited Conduct
You agree not to:
- Use Winnelo for any unlawful purpose or in violation of applicable law
- Attempt to gain unauthorised access to the platform or other users' accounts
- Reverse engineer, decompile, or disassemble any part of Winnelo
- Introduce malware, viruses, or any other malicious code
- Scrape or systematically extract data from the platform
- Use automated tools to interact with the platform in a way not sanctioned by Winnelo
- Impersonate any person or entity
- Share your account credentials with others or allow multiple individuals to use a single account
- Use the platform in a way that could damage, disable, or impair its operation
5. Administrator Responsibilities
Administrators are responsible for all content they create or publish on Winnelo. By publishing content, you represent that:
- You have the right to use and publish the content
- The content does not infringe the intellectual property rights of any third party
- The content is accurate to the best of your knowledge and does not contain harmful or misleading material
Administrators are also responsible for managing user access within their organisation, including inviting, supervising, and removing learners where necessary.
6. AI-Generated Content
Winnelo offers an AI-assisted question generation feature powered by Anthropic's Claude. Content generated by AI is provided as a starting point for administrators and must be reviewed before publishing. Winnelo does not guarantee the accuracy, completeness, or suitability of AI-generated content. Administrators remain solely responsible for all published content.
7. Intellectual Property
Our Platform
Winnelo, including all software, designs, branding, and underlying technology, is the exclusive property of Winnelo and is protected by intellectual property laws. Nothing in these Terms grants you any rights beyond what is necessary to use the platform as described.
Your Content
You retain ownership of any content you create on Winnelo. By publishing content on the platform, you grant Winnelo a limited, non-exclusive licence to store, display, and deliver that content to the intended recipients within your organisation for the purpose of providing the service.
8. Service Availability
We aim to keep Winnelo available at all times, but we do not guarantee uninterrupted or error-free access. We may suspend or modify the platform for maintenance, security updates, or other operational reasons, and will endeavour to provide reasonable notice of planned downtime where practical.
9. Disclaimer of Warranties
Winnelo is provided "as is" and "as available", without warranties of any kind, express or implied. To the fullest extent permitted by law, Winnelo disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Winnelo and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of Winnelo.
Our total aggregate liability for any claims relating to the platform will not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) £100 GBP.
11. Indemnification
You agree to indemnify and hold harmless Winnelo and its officers, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of Winnelo, your violation of these Terms, or your infringement of any third-party rights.
12. Termination
Either party may terminate use of the platform at any time. We reserve the right to suspend or permanently deactivate accounts that violate these Terms, without prior notice. Upon termination, your right to access Winnelo ceases immediately.
Provisions that by their nature should survive termination — including intellectual property rights, disclaimer of warranties, and limitation of liability — will remain in effect.
13. Changes to These Terms
We may update these Terms from time to time to reflect changes to the platform or legal requirements. When we do, we will update the "Last updated" date above and, for material changes, notify account holders by email. Continued use of Winnelo after changes are posted constitutes acceptance of the revised Terms.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or related to these Terms will be subject to the exclusive jurisdiction of the courts of England and Wales.
